Definitions

• “SAWiT” and SAWiT.AI” shall mean a brand of Growthrive Private Limited, a company with CIN number U72900HR2022PTC105044, incorporated in terms of the laws of India.
• “SAWiT” means a community of South Asian Women in Technology which is the owner of this website. This website supports the development and growth of SAWiT.
• “SAWiT.AI” means a combination of 3 Gen AI events for Indian women who are in technology or from other domains but motivated/curious to gain basic Gen AI skills.
• SAWiT.AI Learnathon: World’s Largest Day of Gen AI Learning Event on September 21st 2024 where 500,000 women will gain hands-on experience in using AI tools, building a simple AI application retrieval-augmented generation (RAG) application and publishing it online.
• SAWiT.AI Hackathon: World’s Largest, Women-Led Gen.AI Challenge in October 2024. A hackathon for learning event participants who want to compete, challenge themselves and pursue more challenging Gen AI applications.
• SAWiT.AI Celebration: A Gen AI Festival in November 2024 to award the winners of the Gen AI challenge, acknowledge key sponsors and partners and felicitate the institutions who led the participation tables/ leaderboards (Gen AI Pioneers)
• “Kalido” means an AI-powered talent platform that enables users to create profiles, discover members with shared interests and skills, find and/or become mentors, match to job and upskilling opportunities and get personalized guidance for skills and career development.
• “GUVI” means an Edtech platform provided by a third-party partner, offering a comprehensive suite of learning solutions for self-led and instructed orchestrated learning. It includes interdisciplinary tech tracks, immersive labs and domain infused projects for industry readiness.
• “Contact Details” means the contact details for SAWiT and SAWIT.AI, from time to time and currently as follows:

• “Materials” means all of the material on SAWiT’s and SAWiT.AI’s content based Website and/or App, including but not limited to the texts, drawings, data, video content and information.
• “Basic Members” or Basic Membership shall mean the users who have registered and paid a monthly or annual fee giving them access to membership services and benefits including the online community network, free content, and access to the SAWiTJobs. You will also be able to attend events and access GUVI programmes at an additional fee. You acknowledge that the content and scope of the Basic Membership may be changed from time to time with notice to you.
• “Premium Members” or Premium Membership shall mean the users who have registered and paid a monthly or annual fee giving them access to services in addition to those offered under a Basic Membership. These Premium Membership benefits include: All benefits for a Basic Membership PLUS free self directed learning GUVI course(s) OR an additional discount on one of GUVI’s Zen classes. The number of courses and % additional discount will be specified on the membership page on www.sawitnetwork.com. You acknowledge that the content and scope of the Premium Membership may be changed from time to time on notice to you;
• “Products” means the SAWiT Network products available on the Website, including but not limited to memberships, events, content based products such as GUVI assessments and courses and business information.
• “Registered Members” means the users who followed the registration process and have registered for membership on the SAWiT Network Website. This includes both Basic Members and Premium Members.
• “Services” means the services provided on the SAWiT Network Website by SAWiT Network to a Registered Member.
• “Terms” means these Website Terms and Conditions for using the Website and forming a binding agreement between SAWiT Network and users and Registered Members.
• “Trade Marks” collectively means the trade marks, names, logos and domain names of SAWiT Network, reflecting on the Website or that of SAWiT Network members when authorized to display their brands on the SAWiT Network website.
• “Website” means the official Website for SAWiT located at www.SAWITNETWORK.com, or any SAWiT related websites;
• “You” or user or any derivative of the word means any person, natural or otherwise, acting in their personal capacity or otherwise and accessing, logging-in, registering, viewing or using the Website.

Introduction

• This is the Website for SAWiT. SAWiT is a platform for the development and support of South Asian Women in Technology.
• SAWiT provides the information contained in this Website and the pages comprising the Website and offers the Products and/or Services and access to the Online Network and other services advertised on this Website from time to time to Registered Members, subject to the Terms and Conditions set out herein.
• Please read these Terms, they will govern our relationship with you, as a User, and/or the Registered Member in relation to your use of the Website and will constitute an on-going binding agreement between SAWiT and yourself. You should also read our Privacy Policy (“the Policy”) which is incorporated into these terms by reference.

Acceptance Of Terms And Standard Terms And Conditions

• By accessing or registering on the Website, you are deemed to have read, understood and agreed to the Terms and the Policy. SAWiT Network may at any time modify any of the Terms and such modification will supersede and replace any previous Terms. The amended Terms will be made available on the Website. Each time you access the Website, you agree to be bound by the Terms, as they have changed.
• If you do not accept these Terms, please do not continue to use this Website. Please note that the Terms stated in this document refer to the use by you of this Website and are not related to any commercial agreement concluded between you and SAWiT or any other third party, including any payment portals or eventing websites, pursuant to the use of this Website.

• While SAWiT Network makes every effort to update the Material provided on the Website on a regular basis, SAWiT Network makes no representations or warranties, whether express, implied in law or residual, as to the accuracy, completeness or reliability of any Material, information, data and/or content on the Website.
• SAWiT has offices in Gurgaon, Harayana and the Material related to the products and Services featured on this Website are based on the laws of India unless otherwise expressly stated. Your use of this Website and any dispute arising out of the Website is subject to the laws of India. Any dispute arising out of the use or publication of this Website is subject to the exclusive jurisdiction of the courts of Gurgaon, Harayana.

Use Of The Website And Indemnification

• All users have access to the public and non-member products, services and areas of the SAWiT Network website.
• Only current Registered Members of SAWiT are allowed access and use of the member products, services and areas of the SAWiT website including the online network itself.
• By accessing the Website, you warrant and represent to SAWiT that you are legally entitled to do so. If you subscribe for any of our Products or Services you warrant and represent that you are legally authorized to subscribe for such Services and are of legal age to enter into a contract.
• You further warrant you will not use the Website, the Products and/or the Services or any Material made available or sent to you by us pursuant to your use of the Website for any purpose that is unlawful or prohibited under Indian or international law or is contravention of the Terms.
• You hereby expressly indemnify SAWiT against any loss, liability, damage or expense of whatever nature which SAWiT or any third party may suffer which is caused by or attributable to, whether directly or indirectly, a breach by you of any of the warranties in these Terms or of any laws which bind either Party. Further, SAWiT shall be held harmless against any loss or damage, how ever it may arise suffered by you or any third party as a result of your use of the SAWiT Network website. You use the SAWiT website, Online Network and access the Materials, Products and Services entirely at your own risk.
• SAWiT Network may modify, withdraw or deny access to this Website at any time.
• You may print pages for your personal use but no part of this Website may be reproduced or transmitted for any other purpose.
• This Website is intended to provide general information regarding SAWIT, our Products, Memberships, Online Network and Services, and other information which may be of interest to you. It is not intended to provide exhaustive treatment of any subject. The information on this Website including all research, opinions or other Material is not intended to and does not constitute financial, accounting, tax, legal, investment, consulting or other professional advice or services. Before making any decision or taking any action which might affect your personal finances or career you should take appropriate advice from a suitably qualified person.
• SAWiT regards it as important to protect their users and Registered Members, by abiding to all relevant laws and requesting its users and Registered Members and third parties to do the same.
• You agree not to use SAWiT to break any laws, or act in a generally unpleasant way. ‘Unlawfulness’ and ‘unpleasantness’ include, but are not limited to:
• - Breach or infringement of copyright, contract, intellectual property, and all other applicable local and international laws;
• - Behaviour that jeopardizes your, or any other User’s, or SAWIT’s safety. For example, you shouldn’t allow anyone else to log in to your personal profile or share your login details (this could harm you). You also shouldn’t use anyone else’s work without their permission (this harms them). Nor should you post hateful or offensive content (this harms us and other SAWiT Users);
• - Harassment, intimidation, fraudulent or obscene behavior;
• - Breach of any applicable policies;
• - Modifying the SAWiT app or website;
• - Accessing the SAWIT servers, communications, or data using anything other than an unmodified SAWIT app;
• - Activity designed primarily to overload SAWIT’s servers, or otherwise negatively affect other SAWIT Network users’ experience.
• Registered Members and users are encouraged to report untrue, inaccurate, defamatory, illegal, infringing and/or harmful content or any prohibited behavior available from SAWiT’s Website to its board of directors. SAWiT undertakes to correct and/or remove such content or any part thereof if the person reporting such content provided reasonable grounds to prove the alleged nature of the content. Should you wish to report any problematic content please do so on support@sawitnetwork.com
• We may temporarily or permanently limit or terminate your membership, or delete any of your User Submissions or use of any of the Services, Products or the Online Network if you are suspected to be in breach of these terms.

Sharing Of Data With Partners

• By registering on the SAWiT Website for Membership or for the SAWiT.AI event, you give SAWiT the permission to share all relevant data with Kalido and GUVI, for Kalido and GUVI to set up user accounts on their platforms and for them to send you relevant membership related operational and marketing communications. This is necessary to ensure your membership benefits are activated, you are notified of their activation and to maximize the value of the member benefits you become eligible for.

Copyright And Intellectual Property

• Copyright and all intellectual property rights and all Materials are owned by SAWIT, alternatively SAWIT is the lawful user thereof, and are protected by both Indian and international intellectual property laws.
• Any unauthorized copying, reproduction, retransmission, distribution, dissemination, sale, publication, broadcast or other circulation or exploitation of such material or any component thereof will be an infringement of such copyright and other intellectual property rights; save that you may use the Materials or any component thereof for your own internal purposes and for purposes of considering and making use of the Products and/or Services or Membership offered by SAWiT.
• The Trade Marks displayed on this Website and/or App are registered and unregistered trade marks of SAWiT or an authorized SAWIT member. Nothing contained on this Website and/or App should be construed as granting any license or right to use any trade mark without the prior written permission of SAWiT or the requisite SAWiT member.
• Registered Members are granted a worldwide, royalty free license to use and display the SAWiT logo in association with their brand as long as they remain validly Registered Members. However, SAWiT retains the right to revoke this license, should your use of the logo be deemed inappropriate or should you bring the SAWiT Network brand into disrepute through your association with it including but not limited to by engaging in illegal or fraudulent activities. This decision shall be entirely at the discretion of the SAWiT board of directors.
• Any Material available on the website that is subject to the Copyright of a third party is used either with third Parties consent or is used in terms of the principles of fair use and only for informational or education purposes. If you believe that any Material on the website infringes your copyright or that of a third party please draw this to our attention by emailing us on: vikas@growthrive.me.
• You may make submissions on the Online Network. By sharing content with us (this is called your ‘User Submissions’ in legal jargon), you are granting us, and our third party licensors, a license over your content. And for further legal jargon, please note that this license, as applicable, is royalty-free, sub-licenseable, irrevocable, and worldwide, provided that when you delete your account, we will stop displaying your content, and delete all your user content from our servers subject to our Privacy Policy.

We do not warrant that the Website or any software available for download via the Website, if any, is free of viruses or destructive codes.
• Neither SAWiT or its board of directors, officers, employees, licensor or representatives shall be responsible for, and they hereby disclaim all liability for, any loss, liability, damage (whether direct, indirect or consequential) and/or expense of any nature whatsoever which may be suffered by you or any third party, as a result of or which may be attributable, directly or indirectly, to your access and use of the Website, any third party plugins, payment portals or eventing website links, and/or any information contained on or received via the Website, your use of the Service/s and/or your reliance on any information offered via the Website, Online Network, Products, Service/s and Memberships.
• Without limiting the generality of the aforegoing, neither SAWiT nor its board of directors, officers, employees, licensor or representatives shall be liable for any loss of business, income, loss of data and/or loss of profits, any failure and/or unavailability of the Website for any reason whatever and/or the failure/delay by any third party Service provider to render any Service/s which are necessary to ensure the availability of the Website or its ancillary functions.

We will not be liable for any loss, harm or damage suffered by you as a result of transmitting information to us unless such liability is conferred upon us by legislation.

• This Website is made available for viewing by Users on the basis that SAWiT excludes, to the extent wilfully permitted all liability whatsoever for any loss or damage howsoever arising out of the use of this Website or reliance upon the content of this Website.

Cancellation And Refunds

• You may cancel your SAWiT membership at any time by sending an email to support@sawitnetwork.com or canceling your subscription on the SAWiT website. We offer the ability to pay monthly via a signed banking mandate or annually in advance.
• Accordingly, if you cancel a monthly paid membership before the renewal date you will be liable for monthly payments till the end of your membership terms, which is 12 months.
• If you paid annually upfront, there is no refund. A year is calculated from the date of registration.
• You will have 4 weeks from the date of subscription to cancel your subscription by selecting the cancel subscription option on the SAWiT website. You will only be refunded your subscription fees if you have not availed any of the services included in the Premium Membership package. If you have availed these services, your subscription cannot be canceled and you are liable for the full annual membership fees.
• You acknowledge that any additional Services and Products including GUVI, events and courses are non-refundable once purchased. Events may be subject to their own cancellation and refund terms.
• Registration for the SAWiT.AI event is non-refundable.
• Refunds will be processed within 5-7 working days.
